What should I do about this renting situation?

We moved into a large apartment complex Oct 1 2009. Pets are allowed but they do have breed restrictions. we have a mixed dog..Rotti and Lab. He is 4 years old and around 80 pounds. When we first moved in we didn't bring him to the apartment because we weren't sure how he'd do in a smaller space. He is living in the country with a friend. Well we decided to bring him home and see how he'd do. He was great! Very calm and acted perfect. Well someone complained that we had a Rotti. We immediately took him back to our friends house. Last week we talked to the property manager and she said to let her meet our dog and make a decision. Well we went and got him and she said no he looks too much like a rotti. We accepted that and took him back to our friends house. Well the other day I saw a lady with a very large Pitt bull (also not allowed) and another lady with 2 Rotti's (but they still have their tails) and a man with an English Bulldog (also not allowed). This irritated me but I kept quiet. Yesterday I went to the mail box and saw the property manager sitting in the courtyard playing with the English Bulldog...hello that dog is on the NO list!!! I feaked out and called the office and spoke with a leasing agent. She said they know the other dogs are there and couldn't give me an explanation as to why they can be there. My question is...what would you do? What can I do? I want to go get my dog because what is fair for 1 should be fair for all. I understand we could be evicted and we are planning on moving when our lease is up. Our rent is always paid on time and we never have any complaints against us. I have pictures of the other dogs. If they do evict us could we go to court and try to fight it? Shouldn't the other tenants get evicted as well? What exactly are my rights? The other dogs are not grandfathered in. We already checked into that. These are dogs that came after we had already signed our lease. Like 4 months after we signed ours. We are in the process of filing a discrimination suit as we speak. UPDATE!!!! Just talked to the regional manager...there is no such thing as grandfathered in at this complex. Any dog on the list when the breed restriction started has to go at the end of their lease. Tons of people are going to be out!!! Leases are not going to be renewed for those people!!! HAHAHAHA

  1. The other dogs may have been there before the breed restriction rule was put in place. If so, they are grandfathered and there is nothing that the management can do to remove those dogs. They are not legally required to offer you any explanation at all. When it comes to real life, fairness is not a requirement. You do not have the right to bring your dog onto the premises. If you do, you can be evicted. There is no defense for you to fight the eviction with. The other tenants may be grandfathered. Your rights are to pay your rent per your lease, not bring your dog on the property and move out when your lease is up.
  2. Even if the other dogs weren't grandfathered in it really doesn't matter. They are not required by law to make any explanation to you about anything. Actually they could get in trouble for discussing other residents personal information. It's called the Privacy Act. All it takes is a doctor note saying that a pet is needed as service animal or companion and the apartment complex has to let the animal stay there without a pet fee or pet rent. Of course if that animal causes damage the resident would be charged for it. Didn't your mother ever tell you to worry about yourself and stop being a tattle tale? Follow the rules and if someone else is getting away with breaking them then so be it. Do something productive with your life.
